Virginia Data Center Generator Rule Takes Effect On 4 November

Two days from now, the world's densest data center market gets a binding rule for its backup generators. Article 7 of Virginia's air regulations, titled emission standards for data center engine generator-sets, takes effect on 4 November. The State Air Pollution Control Board adopted it on 18 August, and it was published in the Virginia Register on 5 October.

Each Engine Has To Pass On Its Own

The rule puts into regulation a state law passed earlier this year. The state environment department may not issue a covered permit unless the emission limit for each generator set is no higher than that of a Tier 4 equivalent unit. Law-firm and consultant write-ups stress the word "each": a cap for the whole site does not meet the requirement.

The text says "equivalent" and not "certified". Commentators read this as a performance standard. In practice the benchmark is a diesel engine with exhaust treatment for nitrogen oxides, carbon monoxide and soot, or a proven alternative, and the department decides case by case whether a design qualifies. The rule is a floor: the department can still ask for more.

Who Is Caught

The rule covers data centers as defined in the state tax code, in essence facilities that store and process data and house power and cooling equipment of at least one megawatt. It applies to air permit applications filed on or after 1 July 2026, including general permit coverage, and a change to an existing permit can also bring it in. Applications filed before that date should be checked with the department.

The state also has guidance that sets a presumptive emission limit for these generators and expects most new units to be permitted as non-emergency. A report in May noted that environmental groups see a trade-off in this: cleaner engines may be allowed to run more often.

What Changes At The Site

Exhaust aftertreatment brings extra equipment, weight and a different heat load around each set, and the operator takes on the upkeep of it. Anyone writing a specification for a Virginia site should ask early which engines are offered with the treatment and what the permit will count. Other states are moving the same way, so the question is unlikely to stay in Virginia. See our data centers page for the wider picture.
